1. Legal guarantee of conformity
In accordance with Article 357 of the Digital Code, all goods sold on the Site are supplied in accordance with the contract concluded, and the seller is liable for defects of conformity existing at the time of delivery, as well as for defects resulting from the packaging or from assembly instructions where these were placed on the seller by the contract or carried out under its responsibility.
In accordance with Article 358 of the Digital Code, goods conform to the order:
- if they are fit for the use normally expected of similar goods and, where applicable, if they correspond to the description given by the seller and have the qualities it presented to the buyer, or if they have the qualities a buyer may legitimately expect in light of the public statements made by the seller, in particular its advertising;
- or if they have the characteristics agreed between the parties, or are fit for any particular purpose sought by the buyer and brought to the seller's knowledge.
2. Reporting non-conformity
In accordance with Article 359 of the Digital Code, you have 15 business days from taking possession of the goods to report non-conformity to the seller. Reports are made by email to support@vanterraglobal.com or by registered letter with acknowledgement of receipt.
Defects of conformity appearing within 24 months of delivery are presumed to have existed at the time of delivery, unless proof to the contrary is given. The seller may rebut this presumption where it is incompatible with the nature of the goods or with the defect invoked.
3. Remedies in the event of a conformity defect
In accordance with Article 361 of the Digital Code, in the event of a conformity defect you choose, free of charge, between:
- keeping the goods and having part of the price refunded by the seller;
- returning the goods to the seller and having the whole of the price refunded;
- returning the goods to the seller and having new goods conforming to your order delivered.
These remedies are without prejudice to the award of damages.
In accordance with Article 362 of the Digital Code, the action arising from a conformity defect is time-barred after two (2) years from delivery of the goods.
4. Guarantee against hidden defects
In accordance with Article 363 of the Digital Code, the seller guarantees the goods sold against hidden defects that render them unfit for the purpose for which they are intended, or that diminish that purpose so much that the buyer would not have acquired them, or would have paid a lower price, had they known of them.
In accordance with Article 365 of the Digital Code, an online goods seller is liable for hidden defects even if it was not aware of them at the time of the order. The seller is not, however, liable for apparent defects which the buyer could have discovered for themselves (Article 364 of the Digital Code).
In accordance with Article 366 of the Digital Code, where hidden defects are discovered after you take possession of the goods, you choose, free of charge, between: keeping the goods and having part of the price refunded; returning them and having the whole of the price refunded; or returning them and having new goods free from defects delivered.
In accordance with Article 369 of the Digital Code, the action arising from hidden defects is time-barred after two (2) years from discovery of the defect.
In accordance with Article 360 of the Digital Code, the buyer is entitled to require that the goods conform to the order. They may not, however, dispute this conformity by invoking a defect they knew or could not have ignored when placing the order. The same applies where the defect originates in materials they supplied themselves.
5. Cases of exclusion
The guarantees do not apply to apparent defects which the buyer could have discovered for themselves, nor to defects resulting from improper use of the goods, careless handling, exposure to abnormal conditions or normal wear and tear.
